What Could Possibly Go Wrong During This Joint Session Of Congress?
Happy new year to you and yours! As we kick off 2025 with many of you enjoying an extended holiday break, our team thought it would be timely to review the critical steps involved in the election certification process. Yes, January 6th 2.0 is fast approaching!
It does not appear that 1/6/25 or “J6 2.0” is being treated as a normal, run-of-the-mill, election certification day. In late December, the Department of Homeland Security issued a National Special Security Event (NSSE) designation for 1/6/25. These “special” designations are typically issued for “big” events like Presidential Inaugurations or State of Union addresses. 1/6/25 or “J6 2.0” will mark the first time that this NSSE designation will be used for Congress’ certification of the Electoral College vote. What could possibly go wrong? Well, it looks like the US Secret Service has been put in charge of worrying about those details. The Capitol Police will NOT be the lead law enforcement agency this time around.

As we anxiously anticipate the Joint Session of Congress convening on 1/6/25 to move the election certification process along, it is good to quickly review the steps that have already occurred.
While the election process begins with "We the People" casting our votes in November, the journey doesn’t end there. As many of you are aware, each state is required to certify its election results by a specific date in December. This part of the election certification process is often referred to as the “safe harbor” deadline, a provision in federal law that ensures election results certified by this date are considered final and protected from further legal challenges in Congress. The "safe harbor" provision is codified in 3 U.S. Code § 5, which requires states to resolve any disputes regarding the appointment of electors six days before the Electoral College meets. If a state misses this deadline, its electoral votes could be challenged or excluded during the official count in Congress. The "safe harbor" provision ensures disputes are handled at the state level to avoid chaos breaking out at the federal level.
For the 2024 election, the safe harbor deadline was 12/11/24, as the Electoral College convened on 12/17/24. It is good to note that the Electoral College is not a place, it is a process in an of itself.
Federal law mandates that the Electoral College results be delivered by the fourth Wednesday in December—in 2024, this was 12/25/24. The certified documents were to be transmitted to several key parties, including:
The Vice President of the United States, who oversees the counting of electoral votes in Congress.
The National Archives and Records Administration (NARA), which preserves the official records of the election.
The Archivist of the United States, responsible for ensuring the integrity of the process and that all submissions comply with legal requirements.
This delivery process is designed to ensure transparency and accountability, laying the groundwork for the next phase of the election certification process.
Once the Electoral College votes have been submitted, the 12th Amendment mandates a joint session of Congress to count the votes and officially declare the winner of the presidential election. The 118th Congress has been on recess since 12/23/24 and is scheduled to reconvene for a few hours on Friday, 1/3/25. Elected members of the 119th Congress should be be sworn in on 1/3/25 and the 119th Congress is scheduled to certify the Presidential election on 1/6/25.
January 6, 2025: Joint Session of Congress
What It Is: A joint session of Congress convenes to officially count the electoral votes and declare the winners. This step is required by the 12th Amendment and marks the final certification of the election.
How It Works:
The vice president opens the certified results from each state in alphabetical order.
The results are read aloud.
Any objections to a state’s results must be submitted in writing and endorsed by at least one member of the House and one member of the Senate.
If an objection is raised, both chambers debate the issue separately and vote on whether to accept or reject the contested electoral votes.
This process ensures any remaining disputes are resolved transparently and within the framework of the law.
This is exactly what didn’t happen in January of 2021. Objections regarding the 2020 election results were submitted, but these objections were never investigated. In other words, an insurrection did occur on 1/6/21, but not the insurrection that has been presented by the US MSM. The entire J6 Select Committee “investigation” was likely fraudulent in its entirety. And who made up the “unselect” committee, as Trump refers to it? Liz Cheney, Adam Schiff, Adam Kinzinger, Jamie Raskin, Zoe Lofgren, Stephanie Murphy, Elaine Luria, Pete Aguilar, and Bennie Thompson.
But where is the proof? Well, why would Trump be making statements like this in late December of 2024?
And why would Biden be considering pardons for the J6 Select Committee members? Innocent people don’t need pardons, correct?

The “Declassified with Julie Kelly” substack put out this piece, focusing in on the details surrounding Liz Cheney.
So what happens to Inauguration Day if election certification is delayed on J6 2.0?
January 20, 2025: Inauguration Day
The president-elect is sworn into office, marking the peaceful transfer of power. This date is mandated by the 20th Amendment.
What Happens If Certification Is Delayed?
If no winner is certified by January 20, the Presidential Succession Act allows the Speaker of the House to temporarily assume the presidency until a winner is declared. This ensures continuity of government. This means that Mike Johnson or his replacement as Speaker of the House would assume the role of President. And if the vote for Speaker of the House is delayed, then Senator Chuck Grassley would assume the role as President of the United States, pro tempore.
At the end of the day, the US MSM just wants to make sure you know these 5 or 6 things in no specific order.
First and foremost, election fraud did not occur in 2020 so let’s all behave and just put all the silly talk of election fraud behind us as the facts speak for themselves.
The US MSM also wants to assure you that the J6 Select Committee that investigated the insurrection that allegedly occurred on 1/6/21 operated above board and completed a thorough investigation. Clearly, the J6 Select Committee did nothing wrong and to even suggest that acts of treason occurred would be preposterous.
Rather than ever make mention of sealed and unsealed federal indictments, the US MSM would prefer that you quickly dismiss the fact that sealed indictments remain at historically record high levels with over 500,000 sealed indictments reported as of as of 12/15/24.
In addition, the US MSM would certainly strongly suggest that you pay no attention to Donald J. Trump still not conceding the 2020 election results as of December 2024, or the fact that the Brunson cases remain active at the Supreme Court. Trump is definitely NOT the “tip of the spear” or part of any Continuity of Government operation or anything ridiculous like that.
And the US MSM would vigorously plead that you disregard the footage that aired on live TV showing the troops serving at Guantanamo Bay during the Army vs Navy football game on 12/14/24. Clearly, there is nothing to see here so carry on.
And finally, the US MSM would be the first to tell you to ignore any and all reports that Judge Advocate General (JAG) military tribunals are being held at a minimum of 4 military bases - Camp Justice (Guantanamo Bay Naval Base), Camp Thunder Cove (Diego Garcia, British Indian Ocean Territory), Camp Blaz Marine Corps Base (Dededo, Guam), and Ushaia Naval Base (Tierra del Fuego, Argentine). You know, JAG. The same military personnel that accompanied Trump on to the stage during his inauguration speech back in January 2017.
All of this is just conspiracy theory gibberish that your average American citizen need not think about.
And with all of that said, what could possibly go wrong with the joint session of Congress on 1/6/25?
We are sensing some stormy conditions in the forecast for Washington DC later this week. Those traveling by plane into the DC area can expect abrupt turbulence so all pilots would be wise to keep those seatbelt signs on and shining brightly.
