The US MSM must be banking on the fact that the majority of Americans remain comfortably numb after indulging in Thanksgiving turkey feasts. It is quite a sad state of affairs if you are hearing about this historic motion for the first time from The Fruited Plain. Censorship has apparently reached new and painstaking heights. This motion to compel discovery cites 10 relevant facts. Please keep in mind that legal briefs and motions rarely list opinions, just facts. Honestly, there is a lot to be said with just the statement that these are listed as relevant “facts.”
Our team decided to leave points E-J alone for now as this will require some journalistic patience as details slowly emerge from the court on these matters. For today, we will be honing in on just relevant facts A-D as listed in document 167. We urge our readers to set aside your blurred political lenses, whether red or blue, and simply pay close attention to dates. Plainly stated, DATES MATTER.
It is good to note that the Solar Winds SUNBURST cyber attack cited under relevant fact D was reported as the largest cyber attack on supply chains in the history of the United States with over 18,000 government agencies, organizations, and corporations impacted. On or around 12/8/19, FireEye detected an attack on its systems and the primary hack appears to have occurred on or around 3/26/20. The nation was drowning in COVID frenzy in March of 2020 so most people, including most members of our team, never noticed.
Who were the Sunburst victims, and how were they compromised?
The ultimate targets of this attack were very carefully chosen. Among the 18,000 customers that installed the update were US agencies including parts of the Pentagon, the Department of Homeland Security, the State Department, the Department of Energy, the National Nuclear Security Administration, and the National Treasury. Also included on the list of targets were FireEye, Microsoft, Cisco, Intel, and Deloitte, the California Department of State Hospitals, and Kent State University.
The fact that the update was digitally signed and originated from a trusted source enabled the attackers to gain access to such high-profile targets and hide in plain sight. This is precisely why supply chain attacks are notoriously difficult to detect. They abuse the trust we rely on to safely navigate the internet—a degree of trust is necessary when it comes to software vendors.
Unfortunately, the supply chain attack did not end here.
Microsoft confirmed that the attackers used vendor access to infiltrate 40 additional organizations that weren’t even SolarWinds’ customers. These targets included MalwareBytes, Palo Alto Networks, Mimecast, and Crowdstrike. In the case of Mimecast, a Mimecast-issued certificate that was used to authenticate some of the company’s products to Microsoft 365 Exchange Web Services had been compromised and used for further exploitation, allowing the attackers to intercept traffic, or possibly infiltrate customers’ Microsoft 365 Exchange Web Services, and steal private information.
Our team found it quite interesting that the relevant facts section of document 167 leads with point A indicating that Trump’s legal team is seeking discovery evidence on foreign influence findings relating to the November 2016 election. This evidence is not something that you would think Trump’s legal team would lead with. Trump was elected POTUS in November 2016. Could evidence prove that Trump was not duly elected due to foreign influence? What exactly is Trump’s legal team shining the light on by stating that the conclusion of the classified and declassified election ICA is identical?
A public version of the 2016 Election ICA states that it is a “declassified version of a highly classified assessment,”
The intriguing question about the 2016 election involves the United States Air Force. Was the USAF monitoring elections in 2016? This article may appear to be irrelevant at first glance as Space Force was created under Trump.
However, this article does answer this question. Was the X-37B on an orbital mission during the 2016 election? Answer: Yes.
Relevant fact B is quite the relevant fact, in our humble opinion. Executive Order 13848 - Imposing Certain Sanctions in the Event of Foreign Interference in a United States Election was executed on 9/12/18. Trump was in office for just 21 months when this occurred.

Although there has been no evidence of a foreign power altering the outcome or vote tabulation in any United States election, foreign powers have historically sought to exploit America's free and open political system. In recent years, the proliferation of digital devices and internet-based communications has created significant vulnerabilities and magnified the scope and intensity of the threat of foreign interference, as illustrated in the 2017 Intelligence Community Assessment. I hereby declare a national emergency to deal with this threat.
What does this mean exactly…persons located, in whole or in substantial part, outside the United States? Is a person living in Washington DC considered inside, or in whole or in substantial part, outside the United States? We will leave that alone for right now.
Rather than digress and speculate, we all know with certainty that a national emergency, based on facts, was declared on 9/12/18. Facts involving what exactly? Well, it appears that factual evidence had been secured from the 2016 election or elections held in prior years. This national emergency was declared prior to the mid-term elections occurring on 11/6/18. Trump was not on the ballot in 2018.
Relevant fact C is also quite relevant. CISA has been marketed as “America’s Cyber Defense Agency.”
Document 167, relevant fact C, page 9 indicates that CISA made false and misleading statements after the 2020 election.
The 2020 Election CISA Statement claimed, falsely, that “there was no evidence any voting system had been comprised” and “declared the 2020 election ‘the most secure in American history.’” On November 17, 2020, President Trump fired CISA’s Director. In a public statement, President Trump explained that he terminated the Director because the CISA Election Statement was “highly inaccurate.”
Again, who exactly held the evidence of election fraud at this moment in time? Here is the joint statement from CISA and a host of other people from 11/12/20, just days after the 2020 election and 5 days prior to the firing of CISA’s Director Chris Krebs on 11/17/20.
As Trump Pushes Election Falsehoods, His Cybersecurity Agency Pushes Back (11/14/20)
Trump fired CISA’s Director Chris Krebs on 11/17/23.
It is good to note that Christopher Krebs, director of the Cybersecurity and Infrastructure Security Agency, testified under oath before the Senate Judiciary Committee on 5/14/19.
Krebs testimony involved 5G and the potential threats that these networks and this technology posed to national security.
It is also timely to note that CISA was created in 2018 following Russia's active measures campaign that allegedly disrupted the 2016 election. CISA was created under Trump’s presidency, but after the November 2018 mid-term elections. Again, dates really do matter.
On November 16, 2018, President Trump signed into law the Cybersecurity and Infrastructure Security Agency Act of 2018, which elevated the mission of the former NPPD within DHS, establishing the Cybersecurity and Infrastructure Security Agency (CISA).
NPPD stands for National Protection and Programs Directorate. The question is why did NPPD need its “mission elevated” under Trump?
Our team found it quite interesting that Chris Wlaschin (Election Systems & Software) is listed on this joint statement from 11/12/20. Think logically! Would you willingly agree to issue a joint statement like this 7 days after a Presidential election if you were Chris Wlaschin or any of the other people on the list? Under what circumstances would you agree to do this? The CISA joint statement is pretty “sweeping,” wouldn’t you say, and tightly coordinated? This joint statement certainly suggests that a lot of people where on the same page as of 11/12/20. It literally took an “army” to hush and nullify Trump’s claims.
Chris Wlaschin’s name appeared quite often in this ES&S post that our team compiled in October. As our loyal subscribers might recall, Mr. Wlaschin recently confirmed that cast vote records produced by the ES&S electronic voting machines are the property of “We The People.” Yet, CVRs requested through FOIA submissions continue to be withheld from the public by most counties. Why?
